Prevention of Sexual Harassment at the Workplace: Toolkit on best practices

This report is the result of a series of roundtable discussions with industry thought-leaders as well as a survey across multiple cities in India to discuss the challenges and best practices for preventing sexual harassment at the workplace. The participants shared their challenges and several innovative practices that they adopted to work around these challenges. The intent of this report is to summarize the various best practices that organizations are adopting in relation to the implementation of this law and provide an assessment of the potential legal and practical risks associated with some of these practices.

Prevention of Sexual Harassment Act, 2013

  • Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013 (SH Act): The primary objective is twofold - Prevention of sexual harassment at the workplace and redressal of complaints of sexual harassment
Sexual Harassment Policy

  • 73% of the companies have a gender-neutral sexual harassment policy in place
Internal Committee

  • 48% of the companies had >4 members in their IC (4 members being the statutory minimum under the SH Act)
Training

  • 54% of the companies held training and sensitization sessions for employees once a year
